Welcome to Nakhla Press (nakhlapress.com), a regional English-language gazette serving readers in the United Arab Emirates. These Terms of Use ("Terms") govern your access to and use of the Nakhla Press website and services. By using or accessing nakhlapress.com (the "Site"), you accept and agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Acceptance of Terms

Nakhla Press grants you a limited, non-exclusive, non-transferable right to access and use the Site in accordance with these Terms and any posted policies. We may provide additional terms, rules or guidelines for specific services; those terms will apply in addition to these Terms. Your continued use of the Site after any posted changes constitutes your acceptance of the updated Terms.

2. Intellectual Property

All content on the Site — including text, headlines, graphics, photographs, illustrations, logos, audio, video, and software — is the property of Nakhla Press or its content providers and is protected by copyright, trademark and other intellectual property laws. Unless expressly stated otherwise, you may view, print, and share short excerpts for personal, non-commercial use provided you retain all copyright and other proprietary notices and attribute the content to Nakhla Press with a link to nakhlapress.com.

You may not reproduce, distribute, publicly display, perform, publish, create derivative works from, transmit, or otherwise exploit any content on the Site for commercial purposes without the prior written permission of Nakhla Press. Requests for permission must be made via the /contact/ form on this site.

3. User Conduct and Submissions

You are solely responsible for content you submit, post, upload or otherwise make available on the Site ("User Content"). By submitting User Content you represent and warrant that you have the right to do so and that your content does not violate any law or the rights of any third party.

Prohibited conduct includes, but is not limited to: - Posting unlawful, defamatory, obscene, harassing, hateful, abusive, or discriminatory material. - Impersonating another person or entity, or misrepresenting your affiliation. - Uploading viruses, malware, or other harmful code, or attempting to disrupt Site operations. - Posting spam, unsolicited advertising, pyramid schemes, or other commercial solicitations. - Publishing private information of third parties without consent. - Circumventing Site security, scraping or harvesting data, or interfering with other users’ access.

By submitting User Content you grant Nakhla Press a perpetual, irrevocable, worldwide, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display and perform the User Content in connection with the Site and Nakhla Press’s business, including promotion and syndication. We are not required to pay you for any use of your User Content unless a separate written agreement says otherwise.

Nakhla Press does not endorse User Content and is not responsible for it. We reserve the right (but do not assume the obligation) to monitor, edit, refuse or remove any User Content for any reason, including violations of these Terms.

4. Disclaimers

The Site and all content are provided on an "as is" and "as available" basis. Nakhla Press makes reasonable efforts to publish accurate, timely information, but we do not guarantee completeness, reliability, or accuracy of content. News, commentary and opinions published on the Site are for general informational purposes and do not constitute professional, legal, financial, medical, or other advice.

The Site may contain links to third-party websites. Those links are provided for convenience and do not imply endorsement. Nakhla Press is not responsible for the content, practices, or privacy policies of third-party sites.

Certain jurisdictions do not allow the exclusion of implied warranties; to the extent such exclusions are not permitted, some of the above disclaimers may not apply to you.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Nakhla Press, its officers, directors, employees, agents, contributors and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages arising out of or in any way related to your use of (or inability to use) the Site, even if advised of the possibility of such damages.

Our aggregate liability to you for any direct damages arising out of or related to these Terms or your use of the Site will be limited to the greater of (a) the total fees you have paid to Nakhla Press for the services giving rise to the claim in the twelve (12) months preceding the claim, or (b) AED 1,000 (United Arab Emirates Dirham), except where a higher minimum is required by applicable law. Some jurisdictions do not allow limitations on liability for certain types of damages; where such limitations are not permitted, liability will be limited to the maximum extent allowed.

6. Governing Law and Dispute Resolution

These Terms and any dispute arising from or relating to them or the Site shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of the United Arab Emirates for the resolution of any disputes, unless otherwise required by mandatory law.

7. Changes to the Site and These Terms

Nakhla Press may modify, suspend, or discontinue the Site (or any part thereof) at any time without notice. We may update these Terms from time to time; the "Last updated" date above will reflect the effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

8. Termination

We may terminate or suspend your access to the Site, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, third parties, or the Site. Termination does not limit any other remedies we may have under law.
